Retrospective/notional promotion—Question as to whether members of the District and Sessions Courts Employees Welfare Association who were promoted to the post of Senior Judicial Assistant and Judicial Assistant, from the date of assumption of charge, have any right to seek retrospective promotion or notional promotion from the date when such vacancies arose—Employees do not have any vested or indefeasible right to retrospective/notional promotion, unless the recruitment rules so provide—Since the question is answered in the negative, the members of the Petitioner Association would automatically become ineligible for participating in the Departmental Competitive Examination.
