Section 439(2)—Cancellation of bail—Prayer for—Bail granted to private respondent in a FIR registered under Sections 376, 504, 506 of IPC—Applicant-informant has filed bail cancellation application on ground that private respondent was granted bail based on his assurance that he would marry the applicant-informant—Case of applicant-informant that now the private respondent is not marrying her—During the course of hearing, on behalf of private respondent, it was told that he was ready to marry the applicant-informant—But, the facts remains that bail is not conditional—No ground found for cancellation of bail—Prayer rejected.
