Section 438—Application for anticipatory bail—Maintainability of—An application for anticipatory bail under Section 438 of CrPC is maintainable at the instance of an accused while he is already in judicial custody in connection with his involvement in a different case—It is clarified that each of such applications will have to be decided by the competent courts on their own merits.
