Section 311—Dismissal of application—Challenged—Opportunity to cross examine the witness was once granted earlier which was not availed by the petitioner/accused—Conduct of petitioner in defending the complaint was lackadaisical and the Metropolitan Magistrate rightly observed that the petitioner/accused was resorting to dilatory tactics by repeatedly filing applications under Section 311 of CrPC—Trial court was justified in dismissing the applications of petitioners/accused—Impugned order does not suffer from any illegality or impropriety warranting interference—Petitions dismissed.
