Section 438—Anticipatory bail—Refusal by High Court—Appeal—Appellant has been accused of committing offences punishable under Sections 120B, 420, 467, 468 and 471 of IPC—Appellant is appearing before investigating officer and there is a civil suit pending inter se parties (petitioner and complainant) preceding the present FIR—Impugned order set aside—Appellant is granted anticipatory bail, subject to terms and conditions that may be imposed by the trial court as it deems fit for the purpose—Appeal allowed.
