Sections 13(1)(i) & 13(1)(ib)—Dissolution of marriage on ground of adultery and desertion—Dismissal of petition filed by husband—Appeal—Husband has not produced any evidence to show that wife was having illicit relationship with second respondent nor he has proved that they were living in adultery—No petition under Section 9 of the Hindu Marriage Act was filed by husband to show that he was interested to resume conjugal life with wife—Only in order to make a valid ground in the divorce petition, baseless allegations were levelled by husband—Family Court rightly dismissed the matrimonial case of appellant seeking divorce—Appeal dismissed.
