Happy is the man who finds a true friend, and far happier is he who finds that true friend in his wife. A successful marriage requires falling in love many times, always with the same person. There are so many laws to protect women and such legal protection should be strictly implemented but misuse thereof cannot be ruled out. The Domestic Violence Act, Provisions of Section 498A of IPC, and other laws are being abused and misused not only to keep the husband in a problem but also to arm-twist the in-laws. Many innocents are being dragged into court unscrupulously by their daughter-in-law and their families under the allegations of dowry demand, harassment, misappropriation of dowry articles, etc. Laws that are otherwise in favour of the distressed wife when are sought to be misused by declaring completely incorrect facts and also by suppressing the material aspect, the courts while awarding the maintenance in favour of the wife should take into consideration the separate income and means of the wife. Maintenance is to be fixed based on actual earnings of a person and not based on his being able-bodied person. Likewise, adjustment is the underlying principle of matrimony and petty squabbles cannot be taken as amounting to cruelty in any event, to seek a decree of divorce, even though the rising rate of divorce is a reality. In In many cases, husbands are victims of cruelty, desertion and other matrimonial offences and they suffered harassment, mental torture, mental agony as well as financial losses due to conduct their wives. Even in the ever-increasing disputes in the matrimonies the worse sufferers are children because a couple may get divorced but parents should not be separated. This book is not an attempt to advocate that women are not victims but the legal protection provided them not to be misused in any manner. The present book LEGAL BATTLE WON BY HUSBAND (OR HIS RELATIVES) covers Key Cases of the Supreme Court of India and All High Courts in favour of the husband or his relatives. A thorough search of the law has been made and present work contains 2000 catch-notes of more than 1500 judgments/orders on the subject. Equivalent citations of all leading journals have been systematically arranged under each catch-note and every effort has been taken to give a lucid exposition of the law. The main approach and structure of the book have been retained in the Second Edition, however, with the addition of more case laws and citations of law journals have completely revised the book.

“Maintenance Laws” have been enacted as a measure of social justice to provide recourse to dependant wife and children for their financial support, to prevent them from falling into destitution and vagrancy. There are different statutes providing for making an application for a grant of maintenance/interim maintenance, if any person having sufficient means neglects, or refuses to maintain his wife, children, and parents. The different enactments provide an independent and distinct remedy framed with a specific object and purpose. Maintenance is awarded based on the financial capacity of husband and other relevant factors. Since it is the sacrosanct duty of the husband to provide financial support to the wife and minor children, the husband was required to earn money even by physical labour, if he is able-bodied, and could not avoid his obligation, except on any legally permissible ground mentioned in the statute. This book is a collection of judgment/orders of the Supreme Court of India and all High Courts where the maintenance was denied to the wife or quantum of maintenance was reduced on different grounds. This book is not an attempt to advocate that wives are not entitled to maintenance but where evidence on record demonstrates legally permissible grounds for denial of maintenance to the wife, the courts should consider the same while disposing of the maintenance application/petition. It is to be borne in mind that the liberal interpretation of social welfare legislation is necessary to further the object of the legislation and not to dilute the same. The present book KEY CASES DENIAL OF MAINTENANCE TO WIFE covers maintenance cases in favour of the husband. The main approach and structure of the book have been retained in the Third Edition, however, with the addition of more case laws and citation of law journals this book has been completely revised.
