Sections 333, 353 & 451—Misbehaving and obstructing public servant from discharging their official duties—Conviction—Appellant is 62 years old woman and incident is more than thirty years old—Appellant indulged in the objectionable act of entering the chamber of Commissioner in the Directorate of Women and Child Development—Appellant abused Commissioner in the Directorate by using very bad language—Deputy Director in the Directorate tried to stop the appellant but the appellant pushed her and she suffered a fracture in her little right finger—Considering the seriousness of offence punishable under Section 333 of the IPC and since the punishment prescribed is both of imprisonment of either description and a fine, obviously, the appellant cannot be let off only on a fine—Appellant deserves to be shown leniency when it comes to the substantive sentence—But only because of accused is on bail for a long time, it is no ground by itself to show leniency—It is only one of several factors to be considered—Order of conviction upheld and appellant sentenced to undergo simple imprisonment of one month with fine—Appeal allowed in part.
