Sections 13(1)(i), 13(1)(ia) & 13(ib)—Dissolution of marriage on the grounds of adultery, cruelty and desertion—Appeal—Male child was delivered after six and a half months of gauna—DNA test was done with consent of appellant and due procedure was adopted—DNA report proved adultery—Respondent was able to prove that false FIR was registered by appellant against him and his family members and ultimately there was acquittal in criminal case—Family Court after considering the evidence decided the issue of cruelty in favour of the respondent—Parties were living separately without reasonable cause for a period exceeding two years—Desertion was also proved—No case is made out for interference in the well reasoned judgment passed by the Family Court—Appeal dismissed.
